1. Introduction and Acceptance of Terms Welcome to JourneyByCars, the best travel agency for car rental bookings. These Terms and Conditions ("Terms") govern your use of our website and the services we provide (the "Services"), which primarily involve facilitating car rental reservations with third-party suppliers. By accessing, browsing, or using the JourneyByCars website and/or making a booking, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use our Services.
2. Our Role as a Booking Agent JourneyByCars acts solely as an agent in facilitating your car rental booking. We do not own or operate any vehicles. The contract for the car rental is between you and the specific car rental supplier (the "Rental Company") you select. Booking Confirmation: Once your booking is confirmed, we issue a voucher on behalf of the Rental Company. Rental Contract: When you pick up the vehicle, you will sign a separate rental agreement with the Rental Company. You are subject to both these JourneyByCars Terms and the Rental Company's specific terms and conditions.
3. Booking and Payments A. Booking Process Search and Selection: You search for a vehicle and select a specific car and price option. Payment: You agree to pay the price shown at the time of booking. Payment may be a deposit, a partial payment, or the full rental cost, as specified on the booking page. Confirmation: We will send you a booking confirmation email with your voucher. B. Pricing and Currency All prices are clearly displayed on our website. While we strive for accuracy, in the event of a manifest error, we reserve the right to correct the price and offer you the option to proceed at the correct price or cancel your booking. C. 4. Cancellations, Modifications, and No-Shows A. Cancellation Policy The cancellation policy for your booking will be clearly stated at the time of reservation, as it is determined by the specific Rental Company. You must contact JourneyByCars directly to cancel a booking. Cancellation Fees: Fees may apply and vary based on the proximity of the cancellation to the scheduled pick-up time. Refunds: Any eligible refund will be processed by JourneyByCars according to the Rental Company's policy. B. Modifications All changes to your reservation (dates, vehicle type, etc.) are subject to the Rental Company's approval and may incur a modification fee and/or a change in the rental price. C. No-Shows Failure to pick up the vehicle on the agreed-upon date and time (a "No-Show") may result in the forfeiture of any pre-paid amounts. This includes failing to present the required documents (voucher, valid driver's license, credit card, etc.) at the time of pick-up.
5. Rental Company Requirements (Important) The Rental Company may refuse to provide the vehicle if the required documentation is not presented, or if the main driver does not meet the necessary criteria. In such cases, no refund will be due from JourneyByCars. Required items typically include: Booking Voucher (issued by JourneyByCars). Valid Driver's License (held for a minimum period, usually 1-2 years). Valid Credit Card in the name of the main driver for the security deposit. Passport or ID card. Minimum Age Requirements (varies by country and vehicle, may incur a Young Driver Surcharge).
6. Limitation of Liability JourneyByCars acts solely as an intermediary. We are not liable for: The acts or omissions of the Rental Company or any other third party. The quality or fitness of the vehicle for the intended purpose. Any claims, demands, losses, damages, or costs (including loss of enjoyment or financial loss) arising directly or indirectly from your rental agreement with the Rental Company. Our liability to you for any losses or damages arising from our service as a booking agent is strictly limited to the total amount you paid to JourneyByCars for the booking.
7. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of [Insert Your Governing Jurisdiction Here, e.g., the State of California, USA], without regard to its conflict of law principles.
